Terms of Use

1. Acceptance of Terms

By accessing or using commentable <html> at html.commentable.link(the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms in their entirety, you must not use the Service.

These Terms apply to all visitors, including users who browse shared pages, users who leave comments, and registered users who publish content. Use of the Service constitutes acceptance regardless of whether you have created an account.

2. Description of Service

commentable <html> allows users to:

Publish HTML files or PDF documents as encrypted, private shareable links
Share those links with reviewers who can view the rendered page and leave pinned comments without creating an account
Manage published pages, set expiration dates, and optionally protect pages with a password
Publish programmatically using a personal API key, including through the Claude connector (MCP)
On a paid plan, apply custom branding (name, logo, colors) to shared pages and serve them from a custom domain

The Service is offered on a free tier and one or more paid tiers (“Pro”). Free-tier pages are subject to limits that may change over time, including a maximum link lifetime after which the page automatically expires. Paid features are described on our pricing page and governed by Section 11 below.

The Service is provided on an “as is” basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Accounts and Registration

Publishing pages requires a registered account. When you register:

You must provide a valid email address and keep it current.
You are responsible for all activity that occurs under your account.
You must notify us immediately via our contact form if you suspect unauthorized use of your account.
Accounts are for individual use; you may not share your account with others or create accounts on behalf of others without authorization.
You must be at least 13 years old (or 16 in the EU/EEA) to create an account.
You are responsible for keeping any API keys you generate confidential. An API key can publish pages under your account; treat it like a password and revoke it from your dashboard if it is exposed. You are responsible for all activity performed with your keys.

4. Your Content and License

4.1 Ownership

You retain full ownership of all HTML content you publish through the Service. We claim no intellectual property rights over your content.

4.2 License to Us

By publishing content, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, transmit, and serve that content solely as necessary to operate the Service. This license terminates when you delete the artifact or close your account.

For pages published directly through the Service in your browser, your HTML content is end-to-end encrypted before it reaches us, so our technical ability to exercise this license is limited to storing and transmitting the encrypted ciphertext — we do not decrypt or process that content. Pages published or updated through our MCP/Claude connector API are handled differently: because the connecting application cannot encrypt content itself, that content (and, for updates, the decryption key) passes through our server in memory to perform the encryption, and is never logged or persisted in unencrypted form. See our Privacy Policy §3 for the full scope of this exception.

4.3 Brand Assets

If you upload branding materials (such as a logo) or configure a business name, colors, or a custom domain on a paid plan, you grant us a license to store and display those materials on the pages you share and in related communications (such as email notifications). Unlike your HTML content, brand assets are not end-to-end encrypted — they are stored in ordinary form and served publicly so they can appear on shared pages. You represent that you own or are licensed to use any logo, name, or mark you upload.

4.4 Comments

By posting a comment, you grant us a non-exclusive, royalty-free license to store and display that comment as part of the Service. You represent that you have the right to post the comment and that it does not violate these Terms or any applicable law.

4.5 Content Accuracy

You are solely responsible for the accuracy, legality, and appropriateness of the content you publish and comments you post. We do not verify, endorse, or take responsibility for any user-generated content.

4.6 Feedback and Suggestions

If you submit ideas, suggestions, feedback, or feature requests about the Service (“Feedback”) to us through any channel, you hereby assign to us all right, title, and interest in that Feedback, including all associated intellectual property rights, without any obligation to compensate or credit you. We are free to use, reproduce, modify, and commercialise Feedback for any purpose. If this assignment is unenforceable under applicable law, you grant us a perpetual, irrevocable, royalty-free, worldwide, sublicensable licence to do all of the foregoing.

5. Acceptable Use

You agree not to use the Service to publish, distribute, or facilitate:

Malicious code — viruses, trojans, ransomware, spyware, worms, or any software designed to damage, disable, or gain unauthorized access to systems
Phishing and fraud — pages designed to deceive users into revealing passwords, payment details, or other sensitive information; spoofed login pages impersonating any entity
Illegal content — material that violates any applicable law, including but not limited to child sexual abuse material (CSAM), content that incites violence, or content that facilitates human trafficking
Harassment — content that harasses, threatens, or intimidates individuals or groups
Intellectual property infringement — content that infringes patents, trademarks, trade secrets, copyrights, or other proprietary rights of any third party
Spam and unsolicited distribution — using shared links as part of unsolicited bulk messaging campaigns
Service disruption — actions that impose an unreasonable load on our infrastructure, circumvent security measures, or attempt unauthorized access to our systems or other users' accounts
Automated scraping — using bots, crawlers, or other automated means to access the Service at scale without our prior written consent

We reserve the right to remove any content and terminate any account we determine, in our sole discretion, to be in violation of these Terms or otherwise harmful to users, third parties, or the Service.

6. End-to-End Encryption and Content Responsibility

For pages published directly through the Service in your browser, HTML content is encrypted client-side and we do not possess the decryption key. As a result:

We are technically unable to proactively review your content for policy compliance.
You bear sole responsibility for ensuring your content complies with these Terms and applicable law.
If we receive a credible report of a policy violation and are provided with the full URL (including the #key= fragment), we may, in our sole discretion, disable the URL slug to prevent further access. We are under no obligation to do so.
We cannot recover or restore content if you lose the full URL. This is a fundamental property of the encryption design.

Pages published or updated through our MCP/Claude connector API pass through our server in memory at the moment of publishing (see Privacy Policy §3); we still do not log, retain, or proactively review that content, and the same responsibility and enforcement terms above apply equally to it.

7. External Resources in Published Pages

HTML you publish may reference external resources — images, fonts, scripts, or stylesheets hosted on third-party servers. Be aware that:

External resources may log the IP addresses of people who view your page.
Scripts loaded from external origins may execute in viewers' browsers and are outside our control.
You are responsible for any third-party resources included in your HTML.

We render published pages in a sandboxed iframe to limit the blast radius of any malicious content, but sandboxing does not guarantee complete isolation from externally loaded resources.

8. Copyright Infringement

We respect intellectual property rights. If you believe that content accessible through our Service infringes your copyright, submit a notice via our contact form or by email to support@commentable.link with the following information:

Identification of the copyrighted work you claim has been infringed
The full URL of the allegedly infringing page (including the #key= fragment required to access it)
Your contact information (name, address, telephone, email)
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner
Your physical or electronic signature

We may, in our sole discretion, disable access to the URL slug upon receiving a notice we consider credible. Because content is end-to-end encrypted, disabling the slug is the only enforcement action available to us. We are under no obligation to take action in any particular timeframe. Users who repeatedly have content removed for infringement may have their accounts terminated.

9. Intellectual Property

The Service, including its design, source code, trademarks, trade dress, and all associated intellectual property, is owned by or licensed to commentable and its operators. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary marks without our prior written consent.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

11. Paid Subscriptions and Billing

Certain features (“Pro”) require a paid subscription. By subscribing, you agree to the following:

Payment processor. Payments are processed by our third-party payment provider, Polar. We do not receive or store your full payment-card details. Your use of the checkout is also subject to the payment provider's terms.
Recurring billing. Subscriptions renew automatically at the end of each billing period (monthly or yearly, as you select) at the then-current price, until cancelled. Prices are shown on our pricing page and are exclusive of any taxes that may apply.
Cancellation. You may cancel at any time through the customer portal. Cancellation stops future renewals; you retain Pro access until the end of the period you have already paid for.
Refunds. Except where required by applicable law, payments are non-refundable and there are no refunds or credits for partial periods.
Downgrades. If your subscription ends or a payment fails, your account reverts to the free tier. Pro-only features (such as branding and custom domains) stop applying to your pages, and free-tier limits — including automatic link expiry — resume for pages published thereafter.
Price changes. We may change subscription prices. We will give reasonable advance notice, and changes take effect at your next renewal.

12. API and Programmatic Access

We may provide API keys and connector integrations (including the Claude MCP connector) that let you publish and manage pages programmatically. You agree to use them only as documented, not to exceed reasonable rate limits or place an undue load on our systems, and not to resell or provide access to the API to third parties without our consent. We may rate-limit, suspend, or revoke API access at any time.

13. Custom Domains

If you connect a custom domain on a paid plan, you represent that you own or are authorized to use that domain. You are responsible for configuring the required DNS records. Domain verification and TLS are provided through our hosting provider; we do not guarantee availability of any particular domain or uninterrupted resolution. We may disconnect a domain that is used in violation of these Terms or that we are directed to remove by the domain registrar or a competent authority.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free
Any defects will be corrected
The Service or the servers that make it available are free of viruses or other harmful components
Results obtained through the Service will be accurate or reliable

You use the Service entirely at your own risk.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR OPERATORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total fees you paid us in the twelve (12) months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages. In those jurisdictions, the above limitations apply only to the extent permitted by law.

15.1 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WE EACH AGREE THAT ANY CLAIM AGAINST THE OTHER WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. You expressly waive any right to bring or participate in a class action, class arbitration, or representative action against us.

16. Indemnification

You agree to defend, indemnify, and hold harmless commentable and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of a third party.

17. Termination

We may suspend or permanently terminate your account and access to the Service at any time, with or without notice, for any reason including — but not limited to — violation of these Terms. Upon termination, your right to use the Service ceases immediately.

You may close your account at any time via our contact form. We will make reasonable efforts to delete your artifacts and account data following a verified deletion request, except where retention is required by law.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-law principles. If you are a consumer located in the European Union or United Kingdom, mandatory local consumer-protection laws in your country of residence may also apply and are not displaced by this choice.

18.2 Dispute Resolution

Before initiating any formal proceeding, you agree to attempt to resolve any dispute informally by contacting us via our contact form and allowing 30 days for us to respond.

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be submitted to the competent courts in Tel Aviv, Israel. If you are a consumer in a jurisdiction where this exclusive venue is unenforceable, you may bring claims in the courts of your country of residence.

Nothing in this section prevents either party from seeking injunctive or other equitable relief to prevent irreparable harm.

19. Changes to These Terms

We may update these Terms at any time. We will provide notice of changes by updating the “Last updated” date at the top of this page. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and may request account deletion per Section 17.

20. General Provisions

Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
No waiver: Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign or transfer any rights under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
Force majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters; acts of war, terrorism, or civil unrest; government actions or sanctions; epidemics or pandemics; power or internet failures; actions of third-party infrastructure providers; or cyberattacks.
